BS Aquino orders the Ombudsman to spare criminal charges on DAP use

Former President Benigno Aquino III has asked the Office of the Ombudsman to dismiss with finality the administrative and criminal charges filed against him for implementing the unconstitutional P72-billion Disbursement Acceleration Program (DAP).
Aquino made the request in his counter affidavit to the motion for reconsideration (MR) filed jointly by Bayan Muna Rep. Isagani Zarate and 10 other caused-oriented groups with the Ombudsman questioning the March 3 decision of the anti-graft body that cleared the former of any criminal liability on the utilization of the DAP.

Earlier, former Budget Secretary Florencio Abad filed his MR assailing the Ombudsman’s finding of probable cause to charge him for usurpation of the legislative power of Congress as well as the administrative charges of simple misconduct.

The complainants’ MR insisted that Aquino, together with Abad, should be indicted for technical malversation of public funds, usurpation of legislative power, and corruption for diverting unspent allotments of various government agencies to the Office of the President to finance selected projects.

In a 19-page counter affidavit, Aquino said the MR should be discarded because the allegations cited therein were a mere rehash of issues already discussed and resolved in the decision of the Ombudsman acquitting him of the charges.

He denied seizing the power of Congress to appropriate funds, stressing that he “performed his core executive functions under Article 25 of the Constitution where he utilized what was reported to him as savings and thereafter used such savings to augment items in the budget.”

He explained that the DAP was crafted in 2011 to accelerate public spending and avert the economic downturn.

Aquino pointed out the DAP fast-tracked public spending on projects already existing in the budget to enhance the country’s economic growth.

“Complainants cannot allege, much less show, that any private individual or entity was unduly benefited or enriched in the execution of the DAP, or that the public suffered injury or damage,” Aquino added.
